1. Agreement

These Terms of Service ("Terms") govern your access to and use of PumpkinPatchesNearMe.com (the "Site"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. What the Site is

The Site is an independent, informational directory of pumpkin patches, corn mazes, u-pick farms and related seasonal attractions in the United States. We are not a farm, a ticketing platform, a booking agent or a travel agency. We do not sell admission, take reservations, process payments for farms or act as an agent for any listed business.

3. Use of the Site

You may use the Site for your own personal, non-commercial purposes. You agree not to:

• Scrape, crawl, harvest or bulk-download listing data by automated means, or use the data to build or supplement a competing directory or database;
• Use the Site's contact details to send unsolicited commercial messages to listed businesses;
• Interfere with, overload, probe or attempt to gain unauthorised access to the Site or its infrastructure;
• Remove, obscure or alter any attribution, copyright or trademark notice;
• Use the Site for any unlawful purpose or in violation of these Terms.

Search engine crawlers indexing the Site in the ordinary way, consistent with our robots.txt, are welcome.

4. Listing information

Listings are compiled from public business data sources and from submissions by farm owners and visitors. Listings are provided for information only, are not verified by us, and may be inaccurate or out of date. Inclusion is not an endorsement. Please read our Disclaimer, which forms part of these Terms and sets out important limitations on listing accuracy and on your safety at listed locations.

We may add, edit, reorder, decline or remove any listing at any time, at our discretion.

5. Submissions

If you submit a listing, correction, photograph or other material, you confirm that you have the right to do so and that the material does not infringe anyone's rights. You grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt and publish that material on the Site and in related promotional material. We are not obliged to publish or retain anything you send.

6. Business owners

If you own or manage a listed business, you may request corrections or removal at any time, at no cost, by emailing us from an address associated with the business. Corrections are never conditional on any paid placement.

7. Advertising and paid placement

The Site carries advertising, including advertising served by third-party networks such as Google AdSense, and offers paid featured placement to businesses. Paid placements are identified as such. Paid placement does not affect any business's rating or review count and does not cause any other business to be excluded. Advertisements are not endorsements, and any dealings you have with an advertiser are between you and that advertiser.

8. Intellectual property

The Site's design, layout, text, logo, graphics, code and the compiled arrangement of its directory are owned by us or our licensors and are protected by copyright and other laws. Business names, logos and trademarks belong to their respective owners and are used for identification only. Map data and imagery are provided by third parties under their own licences, including OpenStreetMap contributors and Esri, and remain subject to those licences.

9. Third-party sites and services

The Site links to and loads resources from third-party websites and services. We do not control them, do not endorse them, and are not responsible for their content, availability, accuracy or practices. Your use of a third-party service is governed by that party's own terms.

10. Disclaimer of warranties

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that listing information is accurate or current.

11. Limitation of liability

To the maximum extent permitted by law, PumpkinPatchesNearMe.com and its operators will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, data, goodwill, time or travel costs, arising out of or related to your use of the Site or reliance on its content — including a farm being closed, an address or hours being wrong, or any incident occurring at a listed location. Our total aggregate liability for any claim relating to the Site will not exceed one hundred US dollars ($100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold harmless PumpkinPatchesNearMe.com and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising from your use of the Site, your submissions, or your breach of these Terms.

13. Changes

We may modify these Terms at any time. The revision date above will change when we do, and continued use of the Site after a change means you accept the revised Terms.

14. Termination

We may suspend or restrict access to the Site, in whole or in part, at any time and without notice.

15. Governing law

These Terms are governed by the laws of the United States and of the state in which the Site's operator is established, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the courts of that jurisdiction.

16. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Site.
